Summary

The proprietor of the patent Grey Technology Limited, requested a review under section 74B of the Patents Act of Opinions 15/06, 16/06 and 17/06. Each of these had found that claim 1 of the patent was anticipated by DE 19914574.

The hearing officer construed claim 1 of the patent differently to the Opinions and found it not to be anticipated. He therefore set aside those parts of Opinions 15/06, 16/06 and 17/06 that related to validity.
