Summary
In the light of the decision by Warren J. in Luxim Corporation v Ceravision Limited [2007] EWHC 1624, the hearing office considered whether he should decline to deal with deal under Section 37(8). After consideration of the submissions from the parties he came to the conclusion that the complexity of the issues in the dispute are such that when judged against the expertise and experience to be expected of a hearing officer as compared to that of a judge, it is a matter which would more properly be determined by the court. Accordingly he declined to deal with the dispute.
