Summary
The proprietor of the patent, Sandoz AG, requested a review of opinion number 03/06. That opinion found claims 1-6, 11, 12, 17 and 19 of the patent to be invalid through lack of inventive step. The hearing officer found that the Opinion examiner had not wrongly concluded that the patent was invalid and declined to set aside the Opinion.
