Summary
At first instance (see BL O/219/07) the Hearing Officer had found in favour of the applicants. The opponents appealed, claiming that the decision was plainly wrong in view of the similarity of the marks and the identicality of the goods.
The Appointed Person, however, declined to substitute a different view for that of the Hearing Officer. It had not been established that the Hearing Officer’s approach was in error or that his determination was not one that he was entitled to reach.
