Summary
At first instance (see BL O/013/08) the Hearing Officer had found the opponents successful in respect of all but a few of the goods/services specified in the application.
The opponents appealed in respect of these four.
In the interim, however, the Swiss trade mark which had provided the basis for the International trade mark application in suit had been withdrawn. The Appointed Person therefore took the view that the appeal had become pointless. He proposed that the Hearing Officer’s decision be left in place but the opponents would be free to pursue the applicants in respect of the costs awarded by the Hearing Officer. Neither party objected to this outcome. (In fact the applicants had not since been heard from).
