Summary
This was an application under section 71 for a Declaration as to Non-Infringement in respect of two EP(UK) patents belonging to Mr Crossling. The substantive proceedings fell away after the parties settled at a Case Management Conference (CMC). The only issue remaining to be decided by the Hearing Officer was costs.
The Hearing Officer decided that there was no clear victor in the proceedings, and also that there were no grounds for awarding costs above the standard scale. Both parties had caused unnecessary expense to the other side, and the two opposing awards of costs cancelled out.
