Summary
The defendant, Orbis Corporation who was successful on the substantive action of entitlement sought a cost award off the published scale. This was to reflect the general behaviour of the claimant, Mr Kenneth Farr who was a litigant in person. The Hearing Officer however concluded that notwithstanding that such litigants in person can be infuriating that the circumstances of this case did not warrant a cost award off the published scale. An order in line with the scale was therefore made.
