Summary
This was a Decision on expenses following an earlier substantive Decision on entitlement in favour of the defender.
The hearing officer considered that the behaviour of the pursuer in putting the defender to proof of a fact he knew to be true, and admitted under cross-examination, amounted to unreasonable behaviour, and made an award off the scale to compensate the defender for expenses incurred in establishing this fact. He did not make an award for issues the defender lost on, or for the portion of the proceedings prior to the importance of this fact becoming clear.
