Summary

This case related to a system for controlling the laying of asphalt. The hearing officer found that attacks on novelty, inventive step, and added matter failed and the patent was maintained following an unconditional offer to amend by the defendant.

The hearing officer considered that the claimant’s attacks on the amended form of the patent should have been reflected in amendment to its statement of claim.
