Summary

The application is concerned with a vehicle which hovers above a road surface due to the magnetic repulsion generated between the vehicle and the Earth-™s magnetic field. The base of the vehicle includes amplifiers for amplifying the magnetic field at the road surface, thereby allowing the vehicle to hover above it.

Following the principles set out inEli Lilly v Human Genome Sciences, the Hearing Officer determined that the specification did not contain sufficient information to allow the invention to be performed without undue burden being placed on the skilled person. Specifically, there was no disclosure explaining how to construct or design amplifiers for amplifying the Earth-™s magnetic field at the road surface from a distance. Furthermore, he decided that such information was not part of the skilled person-™s common general knowledge. He thus concluded that the application was classically insufficient, failing the requirement of section 14(3). The application was thus refused.
