Summary
An initial neutral party to proceedings declined the opportunity to contest the case after the initial defendant had been struck out in preliminary decision BL O/563/20. The hearing officer accepted the uncontested facts set out by the claimant and declared that rights in EP12725871.3 and equivalent applications should be transferred from the original applicant to the claimant. The European Patent Office had issued a notification of intention to grant the EP application, but the grant had been stayed pending the outcome of these proceedings. The claimant did not make submissions on costs so no costs order was made.
