Summary

The application is a Divisional application for a wearable device comprising a first circuit board with an antenna, a second circuit board with a controller and a power source wherein the first board is located above the second board and the power source such that the antenna is proximate to the upper surface of the device, and the device is able to receive power and to transmit information via the antenna.

The Examiner had argued that the feature of the same antenna being used to both receive power and to transmit information was added matter not present in the application as filed. However, the hearing officer, followingBonzel,decided that the matter had been disclosed implicitly and thus was not added.

He then applied theWindsurfing/Pozzolitest and concluded that the claims involved the required inventive step. The application was remitted to the examiner for further processing.
