Summary
The examiner declined to exercise discretion to allow extensions of time under Rule 108(1) and 108(3) so that a divisional application could be filed. With the benefit of additional evidence, which was not available to the Office when it reached its preliminary decision, the hearing officer found the applicant-™s circumstances to be exceptional, in terms of severity and extent, and that they had been sufficiently diligent making reasonable allowances for their personal circumstances. The hearing officer agreed to exercise discretion and allow the extensions of time.
