RW Gent Ltd [2024] UKUT 240 (AAC) (6 August 2024)


The termination of the licence of an operator was upheld where the operator, having failed to access the online Vehicle Operator Licensing (VOL) system despite notifications, had failed within the time limit to reply to letters relating to the proposed re-appointment of its transport manager. The operator's claimed IT difficulties in accessing the VOL system were not made out. The fact that the VOL system generates a hard copy of the same letter 7 days later, which is then sent by second class post and in this case was received after the deadline had expired did not affect the position, though that operational matter was something which in the panel's view the Office of the Traffic Commissioners might wish to review.
