FOREIGN COMPENSATION

The Foreign Compensation (Roumania) (Amendment) Order 1964

Present,

The Queen's Most Excellent Majesty in Council

Whereas Her Majesty is authorised to make provision by Order in Council under the Foreign Compensation Act 1950 (hereinafter referred to as "the Act") for the determination by the Foreign Compensation Commission (hereinafter referred to as "the Commission") of claims to participate in compensation received under agreements with foreign governments, and for the distribution by the Commission of such compensation:

And Whereas such provision was made by the Foreign Compensation (Roumania) Order 1961(1) (hereinafter referred to as "the principal Order"):

And Whereas it is now deemed expedient to amend the principal Order:

Now, therefore, Her Majesty, by virtue and in exercise of the powers in that behalf by the Act or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1. There shall be added at the end of Article 6 of the principal Order the following:-

"provided that the provisional determination of the application may be made by one member of the Commission in any case in which the amount claimed by the applicant does not exceed £10,000".

2. There shall be inserted at the end of the third line of Article 14 of the principal Order after the words "by the applicant or his predecessor in title" the following:-

"by reason of one or more of the following, that is to say:-"

3. This Order shall come into operation on 9th April 1964 and may be cited as the Foreign Compensation (Roumania) (Amendment) Order 1964.

EXPLANATORY NOTE

This Order amends the Foreign Compensation (Roumania) Order 1961. Its purposes are:-

(i)

to enable the provisional determination of certain claims to be made by one member of the Foreign Compensation Commission instead of by not less than two members; and

(ii)

to clarify the provisions of Article 14 of the Foreign Compensation (Roumania) Order 1961 concerning the assessment of claims arising out of the Treaty of Peace with Roumania.
