TRANSPORT

The Transport Act 1968 (Commencement No.9) Order 1970

Made

30th October 1970

The Minister of Transport hereby makes this Order in exercise of his powers under section 166 of the Transport Act 1968 and of all other enabling powers:-

1. This Order may be cited as the Transport Act 1968 (Commencement No. 9) Order 1970.

2. The provisions of the Transport Act 1968 specified in columns 1 and 2 of the Schedule to this Order shall come into force for the purposes specified for those provisions in that Schedule-

(a)in relation to the use of vehicles by the Post Office (as established by section 6 of the Post Office Act 1969), on 30th November 1970; and

(b)in relation to the use of vehicles which are farmers' goods vehicles (within the meaning of paragraph 7(1), of Schedule 4 to the Vehicles (Excise) Act 1962), on 1st March 1971.

3. Section 94(8), (9) and (10) of the said Act of 1968 shall come into force on 1st December 1970.

EXPLANATORY NOTE

This Order brings into operation those provisions of Part V of the Transport Act 1968 relevant to operators' licensing (so far as not previously brought into operation) in relation to vehicles used by the Post Office (on 30th November 1970) and to the use of farmers' goods vehicles (on 1st March 1971). The Order also brings into operation (on 1st December 1970) certain provisions of the said Act of 1968 which relate to the amendment and repeal of certain statutory provisions (in particular, those of the Road Traffic Act 1960 which relate to carriers' licensing) and to the making of regulations for the repayment of fees and certain transitional provisions, being (in each case) provisions consequential on the operation of the provisions of the Act relevant to operators' licensing.
