TRANSPORT

The Transport Act 1968 (Commencement No. 6) Order 1970

Made

20th February 1970

The Minister of Transport hereby makes this Order in exercise of his powers under section 166 of the Transport Act 1968 and of all other enabling powers:-

1. This Order may be cited as the Transport Act 1968 (Commencement No. 6) Order 1970.

2. Section 64(5), section 71(8) (except the definition of "pallet"), section 82(6) (except in so far as it relates to any special authorisation under Part V, any record or other document required to be made under section 76 or 81 or any means of identification required to be carried on, or by the driver of, a vehicle in pursuance of the provisions of Part V relating to special authorisations), section 82(7), (8) and (9), subsections (1) to (9) and (11) of section 96 (except in so far as they relate to passenger vehicles), subsections (1) to (9) of section 99 (except in so far as they relate to the entry and inspection of any vehicle or to any equipment installed on any vehicle for the purposes of section 97 or any such record as is mentioned in that section), section 100, section 103(8) and Schedule 11 and section 165 (in so far as it relates to the provisions of Part III of Schedule 18 which refer to sections 73 (as respects goods vehicles only), 186 and 234 of the Road Traffic Act 1960 and to sections 20 and 21 of the Road Traffic Act 1962 of the Transport Act 1968 shall come into force on the 1st March 1970.

EXPLANATORY NOTE

This Order brings into operation on the 1st March 1970 the following provisions of the Transport Act 1968:-

Section 64(5) (which enables licensing authorities in considering applications for operators' licences to be assisted by assessors);

Section 71(8) (which defines "hauling vehicle", an expression used in the definition of "large goods vehicle");

Section 82(6) (which enables officers to seize certain documents and articles and relates to their disposal);

Section 82(7), (8) and (9) (which contains provisions ancillary to section 82(6));

Section 96(1) to (9) and (11) (which relates to permitted driving times and periods of duty of drivers of goods vehicles);

Section 99(1) to (9) (which empowers officers to require the production of, inspect and copy records and other documents and to enter premises);

Section 100 (which enables the Minister and the Governor of Northern Ireland to make provision by order to enable effect to be given to international agreements relating to drivers or crews of vehicles used on international journeys);

Section 103(8) and Schedule 11 (which make amendments to enactments consequential on the introduction of Part VI);

Section 165 and certain provisions of Part III of Schedule 18 (which repeal provisions of the Road Traffic Acts of 1960 and 1962 consequential on the introduction of Part VI as respects goods vehicles).
