The Medicines Act 1968 (Commencement No. 2) Order 1972

The Secretaries of State respectively concerned with health in England and Wales, the Secretary of State concerned with health and with agriculture in Scotland, the Secretary of State for Northern Ireland, and the Minister of Agriculture, Fisheries and Food acting jointly, in exercise of their powers under section 136(3) of the Medicines Act 1968, (as having effect subject to the provisions or Article 2(2) of, and Schedule 1 to, the Transfer of Functions (Wales) Order 1969(1) and section 1(1)(a) of the Northern Ireland (Temporary Provisions) Act 1972 and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following order, hereby make the following order:-

1. The day appointed for the coming into operation of the following provisions of the Medicines Act 1968, that is to say, sections 85(5), 86(3), 93 and 97, shall be 1st September 1972.

2. This Order may be cited as the Medicines Act 1968 (Commencement No. 2) Order 1972.

EXPLANATORY NOTE

This Order brings into operation on 1st September 1972 four provisions of the Medicines Act 1968. These are section 85(5) which prohibits the sale, supply or possession for sale or supply, of medicinal products that are in containers or packages which have false or misleading labels or markings; section 86(3) which prohibits the supply with medicinal products, or possession for such supply, of false or misleading leaflets relating to the medicinal products (under section 91(1) of the Medicines Act 1968 any contravention of those sections is an offence); section 93 which makes it an offence to issue or cause to be issued any false or misleading advertisements or representations relating to medicinal products and section 97 which gives power to the licensing authority to require copies of advertisements relating to medicinal products.
