The Secretary of State for the Environment, in exercise of the powers conferred on him by section 162(1)(i) of the Road Traffic Act 1972 and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of the Road Traffic Act 1972, hereby makes the following Regulations:-

1. These Regulations shall come into operation on 27th May 1974 and may be cited as the Motor Vehicles (Third Party Risks) (Amendment) Regulations 1974.

2. Regulation 7 of the Motor Vehicles (Third Party Risks) Regulations 1972(1) (production of evidence that a motor vehicle is not driven in contravention of insurance requirements), as amended(2), shall have effect as if in paragraph (4), for the words "in the territory of a member state of the Communities, other than the United Kingdom and Gibraltar," there were substituted the words "in the territory other than the United Kingdom and Gibraltar of a member State of the Communities or of Austria, Finland, Norway, Sweden, or Switzerland,".

EXPLANATORY NOTE

Regulation 7 of the Motor Vehicles (Third Party Risks) Regulations 1972 , as amended, provides that where a constable requires the production of evidence of insurance under section 162 of the Road Traffic Act 1972 there may be produced, in the case of a vehicle normally based in an EEC country other than the United Kingdom and Gibraltar, a document issued by the insurer of the vehicle showing certain particulars of the insurance, instead of an insurance certificate. These Regulations further amend Regulation 7 so as to apply the provision mentioned above in relation to vehicles normally based in Austria, Finland, Norway, Sweden or Switzerland.
