The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred upon them by section 106(2), (9) and (10) of the Agriculture Act 1970 and of all other powers enabling them in that behalf, with the consent of the Treasury, hereby make the following scheme:-
1. This scheme, which may be cited as the Milk (Eradication of Brucellosis) (Variation) Scheme 1976, shall apply to the United Kingdom and shall come into operation on 1st April 1976.
2.-(1) In this scheme "the principal scheme" means
(2) The Interpretation Act 1889 shall apply for the interpretation of this scheme as it applies for the interpretation of an Act of Parliament.
3.-(1) Paragraph 4(1) of the principal scheme shall be further varied by adding at the end thereof, the words "and in relation to producers in Scotland on or after 1st April 1976 the rate of payment shall be 0.176p per litre, and in relation to producers in England, Wales and Northern Ireland on or after 1st October 1976 the rate of payment shall be 0.176p per litre."
(2) Paragraph 4(1) of the principal scheme as amended by sub-paragraph (2) of that paragraph and as varied by the preceding sub-paragraph shall have effect as set out in the Schedule to this scheme.

Paragraph 3(2)
"Each board shall make payments at a rate of 0.52p per gallon to each producer registered under the scheme constituting that board in respect of milk which is the subject of a payment under that scheme to or by that producer, being milk to which this scheme applies, except that in respect of such milk sold or deemed to have been produced, as the case may be, within the meaning of sub-paragraphs (a) and (b) of paragraph 3(1) of this scheme, on or after 1st April 1971 the rate of payment shall be 0.8p per gallon, and in relation to producers in Scotland on or after 1st April 1976 the rate of payment shall be 0.176p per litre, and in relation to producers in England, Wales and Northern Ireland on or after 1st October 1976 the rate of payment shall be 0.176p per litre."
By agreement within the milk industries of England and Wales, Scotland and Northern Ireland, metrication of milk farm sales, wholesale sales and milk statistics will take effect on 1st April 1976 in Scotland and on 1st October 1976 in England, Wales and Northern Ireland.
As a consequence of the industries decisions this scheme further varies the Milk (Eradication of Brucellosis) Scheme 1970 to permit the milk marketing boards to pay the brucellosis incentive payments on milk at 0.176p per litre.
The rate of 0.176p per litre is a conversion of the rate of 0.8p per gallon on the basis that 1 litre is equivalent to 0.22 gallons.
