Motor Vehicles (International Motor Insurance Card) (Amendment) Regulations 1977

The Secretary of State for Transport in exercise of the powers conferred by section 157 of the Road Traffic Act 1972, and of all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of that Act, hereby makes the following Regulations:-

1. These Regulations may be cited as the Motor Vehicles (International Motor Insurance Card) (Amendment) Regulations 1977 and shall come into operation on 1st August 1977.

2. The Motor Vehicles (International Motor Insurance Card) Regulations 1971(1) shall be amended in accordance with the following provisions of these Regulations, but nothing in Regulations 3, 4 or 6 of these Regulations shall affect the operation of those Regulations in relation to an insurance card, whether issued before or after the coming into operation of these Regulations, which conforms to the requirements specified in the definition of "insurance card" in Regulation 3(1) of those Regulations as originally made.

3. In Regulation 3 (Interpretation) in paragraph (1)-

(a)the definitions of "chief officer of police" and "police area" shall be deleted; and

(b)for the definition of "insurance card" there shall be substituted the following definition:-

"-�insurance card' means an international motor insurance card issued under the authority of a Foreign Bureau or of the British Bureau which is green in colour and-

(a)

is either in English or a foreign language containing the particulars specified in, and set out in two pages as shown in, Schedule 1 to these Regulations; or

(b)

until 31st December 1977, is either in English or a foreign language in the form specified in Schedule 2 to these Regulations;"

4. In Regulation 4 (Validity of insurance card) in paragraph (1)(e) for the words "in the form of Part I of" there shall be substituted the words "in the form specified in".

5. In Regulation 5 (Third-party risks arising out of the use of motor vehicles by visitors), in paragraph (2) for the words "the next two following Regulations" there shall be substituted the words "the next following Regulation", and there shall be deleted-

(i)paragraph (3) of Regulation 6 (detachment of duplicate page by police constable); and

(ii)Regulations 7 (use of duplicate page in civil proceedings) and 9 (requirements in connection with duplicate pages).

6. For Schedules 1 and 2 there shall be substituted the following Schedules:-

"SCHEDULE 1 (See Regulation 3)

SCHEDULE 2 (See Regulation 3)

(In this Schedule, references to the Convention of 1949 are references of the Convention on Road Traffic concluded at Geneva in the year 1949(2)

EXPLANATORY NOTE

These Regulations amend the Motor Vehicles (International Motor Insurance Card) Regulations 1971 to-

(a) remove the requirement that a motor insurance card for use in Great Britain must contain a duplicate page (Regulations 3, 4 and 6) and

(b) to make certain consequential changes (Regulation 5).
