LOCAL GOVERNMENT, ENGLAND AND WALES

30th May 1977
The Secretary of State for the Environment, in exercise of the powers conferred on him by section 43(2) and (3) of the Local Government Act 1974 and of all other powers enabling him in that behalf hereby makes the following order:-
1. This order may be cited as the Local Government Act 1974 (Commencement No. 2) Order 1977.
2.-(1) The Interpretation Act 1889 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.
(2) In this order, "the Act" means
3. The following provisions of the Act, namely-
in Schedule 8, the entries relating to section 98 of the National Parks and Access to the Countryside Act 1949, sections 1 to 5 and 10 of and Schedule 1 to the Local Government Act 1966, section 49 of and Schedule 9 to the General Rate Act 1967, sections 13(7) and 138(6) of the Transport Act 1968, section 3(1) of the Transport (London) Act 1969, the Housing Finance Act 1972, section 203(5) of and paragraph 12 of Schedule 24 to the Local Government Act 1972 and the Rate Rebate Act 1973,
shall come into operation on 1st June 1977.

Section 43(2) of the Local Government Act 1974 provides that the provisions of the Act specified therein shall come into operation on such day as the Secretary of State may by order made by statutory instrument appoint. This order provides for certain of the provisions to come into operation on the day appointed in the order. The provisions being brought into operation relate to the repeal of certain enactments specified in Schedule 8 to the Local Government Act 1974.
