The National Health Service (Professions Supplementary To Medicine) Amendment Regulations 1978

The Secretary of State for Social Services, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred by paragraph 10(1) of Schedule 5 to the National Health Service Act 1977, and of all other powers enabling them in that behalf, after consulting in accordance with paragraph 11(1) of that Schedule bodies recognised by them as representing persons likely to be affected, hereby make the following regulations:-

Citation, commencement and interpretation

1.-(1) These regulations, which may be cited as the National Health Service (Professions Supplementary to Medicine) Amendment Regulations 1978, shall come into operation on 1st October 1978.

(2) In these regulations "the principal regulations" means the National Health Service (Professions Supplementary to Medicine) Regulations 1974.

Amendment of regulation 3 of the principal regulations

2.-(1) In paragraph (1)(a) of regulation 3 of the principal regulations (requirement to be registered as qualification for specified employment by health authorities) for the words after "appropriate to" there shall be substituted the words "work in that capacity; or".

(2) For paragraph (1)(b) of that regulation (alternative qualification) there shall be substituted the following-

"(b)he is a person who has never been so registered and, immediately before 1st April 1974, was in employment for which he was qualified by virtue of either regulation 3(b) of the National Health Service (Professions Supplementary to Medicine) Regulations 1964(1) or regulation 3(b) of the National Assistance (Professions Supplementary to Medicine) Regulations 1964(2) (employment of unregistered officers who had been similarly employed on 29th June 1964)."

Revocation

3. Regulation 2(1) of the principal regulations (definition of "local authority") is hereby revoked.

EXPLANATORY NOTE

These Regulations amend the National Health Service (Professions Supplementary to Medicine) Regulations 1974 (the "principal regulations") which relate to employment by health authorities of persons as chiropodists, dietitians, medical laboratory technicians, occupational therapists, orthoptists, physiotherapists, radiographers or remedial gymnasts.

Regulation 2(1) substitutes words of clarification in regulation 3(1)(a) of the principal regulations. Regulation 2(2) substitutes for regulation 3(1)(b) of the principal regulations a new subparagraph providing that a person not registered under the Professions Supplementary to Medicine Act 1960 (c. 66) may be employed by a health authority only if he has never been so registered and was similarly employed on 29th June 1964 and immediately before 1st April 1974.
