The Occupational Pension Schemes (Public Service Pension Schemes) (Amendment) Regulations 1978

The Secretary of State for Social Services and the Minister for the Civil Service in exercise of the powers conferred on them by section 51(3)(b) of the Social Security Act 1973 and section 66(1) of the Social Security Pensions Act 1975 and of all other powers enabling them in that behalf, being of the opinion that the occupational pension schemes referred to in these regulations ought to be treated as public service pension schemes for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 and after considering the report of the Occupational Pensions Board on the draft submitted to them, hereby jointly make the following regulations:-

Citation, commencement and interpretation

1.-(1) These regulations may be cited as the Occupational Pension Schemes (Public Service Pension Schemes) (Amendment) Regulations 1978 and shall come into operation on 11th October 1978.

(2) Expressions in these regulations have the same meaning as in the Social Security Act 1973 or, as the case may be, the Social Security Pensions Act 1975.

(3) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of these regulations as they apply for the purposes of the interpretation of an Act of Parliament.

Amendment of the Schedule to the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978

2. The Schedule to the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978 shall be amended by adding thereto the following occupational pension schemes:-

"Simplification of International Trade Procedures Board Pension Scheme;

The pension arrangement between the Department of Prices and Consumer Protection and the Chairman of the National Consumer Council, Michael James Shanks;

The pension arrangement between the Department of Prices and Consumer Protection and the Vice-Chairman of the National Consumer Council, Joan Edith Macintosh ".

EXPLANATORY NOTE

These Regulations amend the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978 so as to add three further occupational pension schemes to the Schedule to those regulations specifying schemes which are to be treated for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 as public service pension schemes.

The report of the Occupational Pensions Board on the draft of these Regulations, dated 4th September 1978, is contained in Command Paper (Cmnd. 7354) published by Her Majesty's Stationery Office.
