The Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978

The Secretary of State for Social Services and the Minister for the Civil Service in exercise of the powers conferred on them by section 51(3)(b) of the Social Security Act 1973 and section 66(1) of the Social Security Pensions Act 1975 and of all other powers enabling them in that behalf, being of the opinion that the occupational pension schemes referred to in the Schedule to these regulations ought to be treated as public service pension schemes for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 and after considering the report of the Occupational Pensions Board on the draft submitted to them, hereby jointly make the following regulations:-

Citation, commencement and interpretation

1.-(1) These regulations may be cited as the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978, and shall come into operation on 30th March 1978.

(2) Expressions in these regulations have the same meaning as in the Social Security Act 1973 or, as the case may be, the Social Security Pensions Act 1975.

(3) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of these regulations as they apply for the purposes of the interpretation of an Act of Parliament.

Schemes to be treated as public service pension schemes

2. The occupational pension schemes the names of which are set out in the Schedule to these regulations shall be treated for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 as public service pension schemes.

SCHEDULE

EXPLANATORY NOTE

These Regulations provide that the occupational pension schemes referred to in the Schedule are to be treated for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 as public service pension schemes.

The report of the Occupational Pensions Board on the draft of these regulations, dated 10th February 1978, is contained in House of Commons Paper No. 277 (Session 1977/78) published by Her Majesty's Stationery Office.
