The Secretary of State for Social Services, in exercise of the powers conferred upon him by section 13(1) of the Social Security (Miscellaneous Provisions) Act 1977 and of all other powers enabling him in that behalf, without having referred any proposals on the matter to the National Insurance Advisory Committee since it appears to him by reason of urgency that it is inexpedient to do so, hereby makes the following regulations:-
1.-(1) These regulations, which may be cited as the Mobility Allowance (Vehicle Scheme Beneficiaries) Amendment Regulations 1978, shall come into operation on 26th May 1978.
(2) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of these regulations as they apply for the purposes of the interpretation of an Act of Parliament.
2. The Mobility Allowance (Vehicle Scheme Beneficiaries) Regulations 1977 shall be amended by substituting in regulation 1(2) (interpretation) for the definition of "vehicle scheme beneficiary" the following:-
"`vehicle scheme beneficiary' means

These Regulations amend the provision of the Mobility Allowance (Vehicle Scheme Beneficiaries) Regulations 1977 prescribing categories of persons to whom section 13 of the Social Security (Miscellaneous Provisions) Act 1977 applies so as to require that where persons have either been provided with, or have applied for, a vehicle, it is a power driven road vehicle controlled by the occupant.
