The Secretary of State, in exercise of powers conferred by section 1(2)(d) of the Merchant Shipping Act 1965 and, after consulting with the organisations referred to in section 99(2) of the Merchant Shipping Act 1970, in exercise of powers conferred by sections 2(2), 3(4), 62(6), 65(3), 68(5), 69(5), 70(2) and 71(2) of that Act and now vested in him(1), by paragraph 3(2) of Schedule 5 to the Merchant Shipping Act 1974 and by section 43(3) of, and paragraphs 4, 6, 8 and 20 of Part VI of Schedule 6 to, the Merchant Shipping Act 1979 and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
1. These Regulations may be cited as the Merchant Shipping (Increased Penalties) Regulations 1979 and shall come into operation on 1st January 1980.
2. The statutory instruments listed in column 1 of the Schedule hereto shall be amended by substituting, in respect of the subject matter specified in column 2 thereof, for the penalties specified in column 3 thereof, those penalties specified in column 4.
3. The Merchant Shipping (Diving Operations) Regulations 1975(2) shall be further amended as follows:-
In regulation 27(2)(a) (offences) for the words "on summary conviction a fine not exceeding £400" there shall be substituted "on summary conviction a fine not exceeding £1,000".
4. The Merchant Shipping (Registration of Submersible Craft) Regulations 1976 shall be amended as follows:-
In regulation 5(1) (offences) for the words "on summary conviction to a fine not exceeding £400" there shall be substituted "on summary conviction to a fine not exceeding £1,000".

These Regulations, pursuant to specified paragraphs of Part VI of Schedule 6 to the Merchant Shipping Act 1979, increase the maximum penalties which may be imposed on summary conviction for breach of the following Regulations, which are amended by these Regulations:
