The Scholarships and Other Benefits (Amendment) (No. 2) Regulations 1979

In exercise of the powers conferred by section 81 of the Education Act 1944(1) and vested in the Secretary of State(2), the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:-

1. These Regulations may be cited as the Scholarships and Other Benefits (Amendment) (No. 2) Regulations 1979 and shall come into operation on 14th June 1979.

2. In Regulation 4 of the Scholarships and Other Benefits Regulations 1977(3) (grants of scholarships and other benefits) for the words "Subject to Regulations 5 and 6" there shall be substituted the words "Subject to Regulation 6".

3. Regulation 5 of the said Regulations of 1977 (restrictions on the making of payments under Regulation 4(d)) is hereby revoked.

EXPLANATORY NOTE

These Regulations revoke Regulation 5 of the Scholarships and Other Benefits Regulations 1977. Accordingly, a local education authority will no longer be required to obtain the approval of the Secretary of State before paying fees etc. under Regulation 4(d) in respect of children attending non-maintained schools.
