The Occupational Pension Schemes (Public Service Pension Schemes) (Amendment) Regulations 1980

The Secretary of State for Social Services and the Minister for the Civil Service in exercise of the powers conferred on them by section 51(3)(b) of the Social Security Act 1973 and section 66(1) of the Social Security Pensions Act 1975 and of all other powers enabling them in that behalf, being of the opinion that the occupational pension scheme referred to in these regulations ought to be treated as a public service pension scheme for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 and after considering the report of the Occupational Pensions Board on the draft submitted to them, hereby jointly make the following regulations:-

Citation, commencement and interpretation

1.-(1) These regulations may be cited as the Occupational Pension Schemes (Public Service Pension Schemes) (Amendment) Regulations 1980 and shall come into operation on 1st April 1980.

(2) Expressions in these regulations have the same meaning as in the Social Security Act 1973 or, as the case may be, in the Social Security Pensions Act 1975.

Amendment of the Schedule to the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978

2. The Schedule to the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978(1) shall be amended by adding thereto the following occupational pension scheme:-

"House of Commons Refreshment Department Pension Scheme".

EXPLANATORY NOTE

These regulations amend the Occupational Pension Schemes (Public Service Pension Schemes) Regulations 1978 so as to add a further occupational pension scheme to the Schedule to those regulations specifying schemes which are to be treated for the purposes of Part II of the Social Security Act 1973 and of Parts III and IV of the Social Security Pensions Act 1975 as public service pension schemes.

The report of the Occupational Pensions Board, dated 20th February 1980, on the draft of these regulations referred to them, together with a statement showing that the regulations give effect to the Board's recommendation, is contained in House of Commons paper No. 472 (Session 1979-80) published by Her Majesty's Stationery Office.
