The National Health Service (Notification of Births and Deaths) Regulations 1982

The Secretary of State for Social Services as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of powers conferred by section 124 of the National Health Service Act 1977(1) and of all other powers enabling them in that behalf, hereby make the following regulations:-

Citation and commencement

1. These regulations may be cited as the National Health Service (Notification of Births and Deaths) Regulations 1982 and shall come into operation on 1st April 1982.

Interpretation

2. In these regulations, unless the context otherwise requires-

"the Act" means the National Health Service Act 1977;

"doctor" means a registered medical practitioner.

Person to whom particulars of births and deaths are to be furnished

3. For the purposes of section 124(2) of the Act (which places a duty on registrars of births and deaths to furnish to the prescribed medical officer of the District Health Authority particulars of births and deaths occurring in the district of the Authority), the prescribed medical officer in England shall be the doctor who holds the post of district medical officer of the District Health Authority for the district in which the birth or death occurred and in Wales shall be the doctor who holds the post of chief administrative medical officer of the District Health Authority for that district.

Person to whom notification of birth is to be given

4. For the purposes of section 124(4) of the Act (which provides for the notification of births to the prescribed medical officer of the District Health Authority for the district in which the birth takes place), the prescribed medical officer in England shall be the doctor who holds the post of district medical officer of the District Health Authority for the district in which the birth takes place and in Wales shall be the doctor who holds the post of chief administrative medical officer of the District Health Authority for that district.

Manner and time for furnishing particulars of births and deaths

5. The particulars of each birth and death which are furnished in pursuance of section 124(2) of the Act shall be in writing and sent not later than 14 days from the date on which they are entered in a register of births or deaths.

Revocation

6. The National Health Service (Notification of Births and Deaths) Regulations 1974 are hereby revoked.

EXPLANATORY NOTE

These Regulations prescribe the medical officer of the District Health Authority to whom registrars of births and deaths are to furnish particulars of births and deaths and to whom notification of births under section 124(4) of the National Health Service Act 1977 is to be given from 1st April 1982.

They also provide for the manner in which and the times at which the particulars are to be furnished.
