The Social Security Act 1980 (Commencement No. 3) Order 1983

The Secretary of State for Social Services, in exercise of the powers conferred on him by section 21(5) of the Social Security Act 1980, and of all other powers enabling him in that behalf, hereby makes the following order:-

Citation

1. This order may be cited as the Social Security Act 1980 (Commencement No. 3) Order 1983.

Appointed day

2. The day appointed for the coming into force of those provisions of the Social Security Act 1980 which are specified in the Schedule to this order shall be 21st November 1983.

Article 2

SCHEDULE

Provisions of the Social Security Act 1980 for which 21st November 1983 is appointed as the day of coming into force.

Provisions of the ActSubject matter
Sub-sections (1) and (6) of section 7 so far as not already in force.Amendments of Family Income Supplements Act 1970.
In Part I of Schedule 1- paragraphs 1(1), 2, 6 and 7Amendments relating to similar treatment for men and women in respect of increases of short-term benefits, invalidity pension, non-contributory invalidity pension, retirement pension and disablement pension for a spouse or children.

In Part II of Schedule 5, the entries relating to sections 44 (so far as it repeals sub-section (5)) and 66 (so far as it repeals sub-section (1)(b) of and Schedule 20 to the Social Security Act 1975); and

the entry relating to section 17(1) of the Family Income Supplements Act 1970.

Repeal of enactments.

EXPLANATORY NOTE

This Order brings into force on 21st November 1983 those provisions of the Social Security Act 1980 which-

(a) amend the Family Income Supplements Act 1970 so as to alter the basis upon which members of a household are treated as a family for the purposes of family income supplement and provide, in particular, that men and women are treated in a similar manner for those purposes; and

(b) enable a measure of similar treatment to be given to men and women in claiming an increase of short-term benefits, invalidity pension, non-contributory invalidity pension, retirement pension and disablement benefit under the Social Security Act 1975 in respect of a spouse or children.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Social Security Act 1980 have been brought into force by commencement order made before the date of this Order.
