The National Heritage Act 1983 (Commencement No. 1) Order 1983

The Lord President of the Council, in exercise of the powers conferred by section 41(1), (4) and (5) of the National Heritage Act 1983 and vested in him(1), hereby makes the following Order:-

Citation

1. This Order may be cited as the National Heritage Act 1983 (Commencement No. 1) Order 1983.

Interpretation

2. In this Order "the Act" means the National Heritage Act 1983.

Coming into force of certain provisions of the Act

3. The provisions of the Act specified in column 1 of Schedule 1 and 2 to this Order (which relate to the matters specified in column 2 thereof) shall come into force on the day specified in the heading to the Schedule in question.

Transitional provision

4. The transitional provision contained in Schedule 3 to this Order shall have effect in connection with the bringing into force of paragraph 2 of Schedule 5 to the Act.

SCHEDULE 1PROVISIONS COMING INTO FORCE ON 3RD AUGUST 1983

Provisions of the ActSubject matter of provisions
Section 40.Amendments and repeals.
In Schedule 5, paragraphs 1, 5 and 7.Minor and consequential amendments.
Schedule 6, so far as it relates to the repeal of section 4(2) of the National Gallery and Tate Gallery Act 1954.Repeals.

SCHEDULE 2PROVISIONS COMING INTO FORCE ON 30TH SEPTEMBER 1983

Provisions of the ActSubject matter of provisions
Section 1.Establishment of the Board of Trustees of the Victoria and Albert Museum.
Section 9.Establishment of the Board of Trustees of the Science Museum.
In Schedule 1, paragraphs 1 to 8, 10 to 18 and 20.Membership, proceedings etc. of the Boards of Trustees of the Victoria and Albert Museum and the Science Museum.
In Schedule 5, paragraph 2, paragraph 3 so far as it relates to the Science Museum and the Victoria and Albert Museum and paragraph 4 so far as it relates to the Boards of Trustees of those Museums.Minor and consequential amendments.

SCHEDULE 3TRANSITIONAL PROVISION

1. This Schedule shall have effect until section 17(1) of the Act comes into force.

2. Paragraph 2 of Schedule 5 to the Act shall apply as if the reference to the Armouries were omitted.

EXPLANATORY NOTE

This Order brings into force those provisions of the National Heritage Act 1983 which are specified in Schedules 1 and 2 to the Order.

The provisions specified in Schedule 1, which are brought into force on 3rd August 1983, concern the amendment and repeal of certain enactments relating to the transfer and loan of works of art.

The provisions specified in Schedule 2 are brought into force on 30th September 1983 (subject to a minor transitional provision). They are all related to the establishment of the Boards of Trustees of the Victoria and Albert Museum and the Science Museum. Initially these Boards are to be established without functions. A subsequent order will bring into force the functions and other provisions relating to the Boards.
