MERCHANT SHIPPING

The Merchant Shipping (Property of Deceased Seamen and Official Log Books) (Amendment) Regulations 1983

The Secretary of State for Transport, after consulting with the organisations referred to in section 99(2) of the Merchant Shipping Act 1970, in exercise of powers conferred by sections 65 and 68(2) of that Act(1) and now vested in him(2), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1. These Regulations may be cited as the Merchant Shipping (Property of Deceased Seamen and Official Log Books) (Amendment) Regulations 1983 and shall come into operation on 1st April 1984.

2. The Merchant Shipping (Property of Deceased Seamen) Regulations 1972(3) are hereby revoked.

3. The Merchant Shipping (Official Log Books) Regulations 1981 and the Merchant Shipping (Official Log Books) (Fishing Vessels) Regulations 1981 shall both be amended:

(a)by the deletion in both of the definition of "the Property Regulations" in regulation 1(2); and

(b)by the deletion of paragraph 36(b) to (e) in column 1 of the Schedule to the Merchant Shipping (Official Log Books) Regulations 1981 and of paragraph 30(b) to (e) in column 1 of the Schedule to the Merchant Shipping (Official Log Books) (Fishing Vessels) Regulations 1981 and the substitution for both deletions of the following-

"(b)each item of such property "

EXPLANATORY NOTE

These Regulations revoke the Merchant Shipping (Property of Deceased Seamen) Regulation 1972, which made provision in respect of certain property and wages of specified deceased seamen. The requirements for entries in log books contained in both the Merchant Shipping (Official Log Books) Regulations 1981 and the Merchant Shipping (Official Log Books) (Fishing Vessels) Regulations 1981 are accordingly amended, but the obligation to record all items of property left on board a ship by a seaman dying while or after being employed in the ship remains.
