The Secretary of State for Transport, in exercise of the powers conferred by sections 47(1) and 50(1) of the Road Traffic Act 1972(1), and now vested in him(2) and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:-
1. These Regulations may be cited as the Motor Vehicles (Type Approval) (Great Britain) (Amendment) (No. 2) Regulations 1984 and shall come into operation on 13th December, 1984.
2. The Motor Vehicles (Type Approval) (Great Britain) Regulations 1984(3) shall be further amended so as to have effect in accordance with the following provisions of these Regulations.
3. In Regulation 3 (Application), in paragraph (2)(e)(iv), for the words "the vehicle is imported" substitute the words "application is first made for a licence for the vehicle under the Vehicles (Excise) Act 1971".
4. In Schedule 1 (Type Approval Requirements)-
(a)in item 4C-
(i)in column (3)(a), after "corrected on 9th June 1982" add "or ECE Regulation 15 as revised on 20th October 1981, corrected on 9th June 1982 and amended on 1st June 1984"; and
(ii)opposite the additional words mentioned in sub-paragraph (i) above from "or" onwards insert-
(A)in column (3)(c), the words "Design, construction and equipment requirements in paragraphs 5 and 6 and, in relation to vehicles designed to carry more than 6 persons, paragraph 12.9."; and
(B)in column (5), "13th December 1984";
(b)in item 5A-
(i)in column (3)(a), after "11th February 1980" add "or ECE Regulation 24 as revised on 11th February 1980 and amended on 15th February 1984"; and
(ii)opposite the additional words mentioned in sub-paragraph (i) above from "or" onwards insert-
(A)in column (3)(c), the words "Design, construction and equipment requirements in paragraph 5. Marking requirements in paragraph 4.4.3."; and
(B)in column (5), "13th December 1984";
(c)in item 6-
(i)in column (3)(a), after "5.ECE Regulation 31 of 2nd June 1975" insert "or 5A. ECE Regulation 31 of 2nd June 1975 as amended on 7th February 1983"; and
(ii)opposite the additional words mentioned in sub-paragraph (i) above from "or" onwards insert-
(A)in column 3(c), the words "Design and construction requirements in paragraphs 6, 7, 8 and 9. Marking requirements in paragraphs 4, 5.3.2 and 5.4."; and
(B)in column (5), "13th December 1984"; and
(d)in items 18, 18A, 19 and 19A, in column (4), delete the words ", if manufactured before 1st October 1985" in each place where they occur.

1. These Regulations further amend the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 by-
(a) amending the condition (iv) attached to the exemption in Regulation 3(2)(e) so as to relate the intention to remain in Great Britain for not less than 12 months to the time when the vehicle is first licensed;
(b) amending the prescribed type approval requirements in Schedule 1 at the items numbered 4C (exhaust emissions), 5A (exhaust emissions) and 6 (lamps-headlamps and filament lamps) as a result of amendments to ECE Regulations 15, 24 and 31 respectively; and
(c) removing the time limit from the exemptions contained in items 18, 18A, 19 and 19A in Schedule 1 (interior fittings and external projections) so that the exemptions for vehicle models approved on or before 1st October 1978 will continue indefinitely.
2. Copies of the ECE Regulations referred to may be obtained from Her Majesty's Stationery Office.
