The Secretary of State, in exercise of the powers conferred on him by section 50(5) of the Fair Trading Act 1973 ("the Act"), hereby makes the following Order:-

1. This Order may be cited as the Monopoly References (Alteration of Exclusions) Order 1984 and shall come into operation on 1st January 1985.

2. Part I of Schedule 7 to the Act (goods and services excluded from section 50) is altered by the substitution for paragraph 7 of the following paragraph-

"7. International carriage by air, otherwise than on a charter flight (that is to say, a flight on which the whole capacity of the aircraft is available for purchase by one or more charterers for his or their own use or for resale)."

EXPLANATORY NOTE

This Order alters the exclusion in Schedule 7 to the Fair Trading Act 1973 for the carriage of passengers or goods by air. The effect of the amendment is to enable the Director General of Fair Trading to make monopoly references under the Fair Trading Act in relation to domestic flights and international charter flights. The effect is also, by virtue of section 51(2) of the Fair Trading Act, that monopoly references by the Secretary of State in relation to such flights will no longer be required to be made jointly with another responsible Minister.
