The Cross-Boundary Bridges (Appointed Days) Order 1985

The Secretary of State, in exercise of his powers under paragraph 54(1) and (2) of Schedule 4 to the Local Government Act 1985, and of all other powers enabling him in that behalf, hereby makes the following Order:-

1. This Order may be cited as the Cross-Boundary Bridges (Appointed Days) Order 1985 and shall come into operation on 29th August 1985.

2. The appointed day for the purposes of paragraph 54(1) of Schedule 4 to the Local Government Act 1985 is 1st October 1985.

3. The appointed day for the purposes of paragraph 54(2) of that Schedule is 1st October 1985.

EXPLANATORY NOTE

This Order appoints 1st October 1985 as, for the purposes of paragraph 54(1) of Schedule 4 to the Local Government Act 1985, the day before which the councils of districts in the metropolitan counties of Greater Manchester, Merseyside, Tyne and Wear, West Midlands, South Yorkshire and West Yorkshire are to agree which of them is to be the highway authority for a highway for which the Secretary of State is not the highway authority and which is carried by a bridge, part of which is situated in one district and part in another district of the same metropolitan county. The Order also appoints 1st October 1985 as, for the purposes of paragraph 54(2) of the same Schedule, the day before which the councils of the London boroughs concerned are to agree which of them is to be the highway authority for a highway which-

(a)immediately before the abolition date (as defined in section 1(2) of the Act) is a metropolitan road (as defined in paragraph 55 of the Schedule); and

(b)does not on that date become a trunk road (as defined in paragraph 55) by virtue of an order under paragraph 53(2) of the Schedule,

and which is carried by a bridge, part of which is situated in one borough and part in another.
