TRANSPORT

The Transport Act 1985 (Commencement No.7) Order 1987

14th July 1987

The Secretary of State for Transport, in exercise of the powers conferred by section 140(2) and (3) of the Transport Act 1985(1), and of all other enabling powers, hereby makes the following Order:

Citation and interpretation

1.-(1) This Order may be cited as the Transport Act 1985 (Commencement No.7) Order 1987.

(2) In this Order, "the 1985 Act" means the Transport Act 1985.

Commencement of provisions

2.-(1) The 1985 Act, except to the extent it is already in force and except for the provisions specified in paragraph (2) of this article, shall come into force on 13th August 1987.

(2) The provisions of the 1985 Act not already in force and excepted from coming into force under this Order are:

(a)section 139(3) in so far as it relates to the provision of Schedule 8 specified in sub-paragraph (b) of this paragraph; and

(b)in Schedule 8, the repeal of the words "such number of" and "as they think fit" in section 37 of the Town Police Clauses Act 1847(2).

Transitional Provision

3.  There shall be added to regulation 5(3) of the Motor Vehicles (Tests) Regulations 1981(3) the following sub-paragraph:

"or (c) section 21(2) of the Transport Act 1985 (a small bus operating under a permit granted under section 19 of that Act).".

Explanatory Note

(This note is not part of the Instrument)

This Order brings into force the provisions of the Transport Act 1985 not already in force, except for the repeal of certain words in section 37 of the Town Police Clauses Act 1847. The provisions brought into force are:

1.sections 18* and 19-21: permits in relation to the use of buses by educational and other bodies and related provisions;

2.sections 85 and 86: incorporation of Passenger Transport Executives in Authorities for their area and consequential amendments;

3.section 126*: application of section 52(1) of the Public Passenger Vehicles Act 1981 (c. 14);

4.section 139(3)* and Schedule 8*: repeals except for the repeal specified above.

Note: An asterisk(*) indicates provisions partially brought into force by commencement orders made before the date of this Order.
