MERCHANT SHIPPING

The Merchant Shipping (Fishing Boats Registry) (Amendment) Order 1987

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by sections 373(5) and 738(1) of the Merchant Shipping Act 1894(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Merchant Shipping (Fishing Boats Registry) (Amendment) Order 1987 and shall come into force on 19th August 1987.

2.  The Merchant Shipping (Fishing Boats Registry) Order 1981(2) shall be amended as follows:

(1) there shall be added to article 4(1) the following proviso:-

(2) for article 4(2) the following shall be substituted:

"(2) The following persons (hereafter referred to as Registrars) shall be the officers appointed to carry out the work of registration and the provisions of this Order:

(a)in relation to a port in the United Kingdom other than a port listed in table C in Schedule 1, the officer who is the Registrar of British Ships for that port;

(b)in relation to a port listed in table C in that Schedule

(i)where the boat is registered under Part I of the principal Act, the officer who is the Registrar of British Ships for that port;

(ii)where the boat is not so registered, an officer of the Secretary of State for Scotland stationed at the place specified in column 3 of that table in relation to the port in question;

(c)in relation to a port in the Channel Islands or Isle of Man, the officer specified in relation to that port in column 3 of table F in Schedule 1 entitled "Channel Islands and Isle of Man".";

(3) for article 6(2) the following shall be substituted:-

"(2) The application shall be made:

(a)in the case of boats registered under Part I of the principal Act, to the Registrar of British Ships of the port of registry at which the boat is so registered; and

(b)in the case of boats not so registered, to the Registrar of the port of registry which is, or is nearest to, the port from which the boat will be employed;

The application shall include such information as the Registrar may reasonably require.";

(4) in article 16(2) for the words "3 months" there shall be substituted the words "1 month";

(5) Schedule 1 shall be replaced by the Schedule set out in the Schedule to this Order; and

(6) the whole of Schedule 3 shall be deleted.

Explanatory Note

(This note is not part of the Order)

This Order amends the Merchant Shipping (Fishing Boat Registry) Order 1981. It provides that in most cases the Registrars for ports of registry in the United Kingdom shall be the officers who are Registrars of British Ships for the ports in question. In ports listed in table C in Schedule 1 of the 1981 Order (as now amended) headed "Scotland" the Registrar is to be an officer of the Secretary of State for Scotland stationed at a specified place, except where the boat is registered under Part I of the Merchant Shipping Act 1894 in which case the Registrar is to be the Registrar of British Ships. There is no alteration in the appointment of Registrars for the ports in the Channel Islands or Isle of Man.

The requirement for an application for registry to be made in a specified form is replaced by a requirement for an application to include such information as the Registrar may reasonably require. The Order also reduces from 3 months to 1 month the period within which evidence of the right of a boat to be registered, which the Secretary of State may demand, must be produced to him.
