SEX DISCRIMINATION

The Further Education Act 1985 (Commencement No.2) (Scotland) Order 1987

The Secretary of State, in exercise of the powers conferred on him by section 7(1) of the Further Education Act 1985(1), hereby makes the following Order:

1. This Order may be cited as the Further Education Act 1985 (Commencement No.2) (Scotland) Order 1987.

2. Section 4 of the Further Education Act 1985 shall come into force, as respects Scotland, on 17th August 1987.

Explanatory Note

(This note is not part of the Order)

This Order brings section 4 of the Further Education Act 1985 into force on 17th August 1987 so far as it relates to Scotland. As a result the provisions of that Act are now completely in force.

Section 4 provides for the repeal of section 28(b) of the Sex Discrimination Act 1975 (c. 65), which excepts courses designed for teachers of physical training from the application of provisions of that Act making sex discrimination in education unlawful. The effect of the repeal is that these provisions will apply to any such course in Scotland which begins in the 1987-88 academic year or later.

Section 4 was brought into force in England and Wales on 16th September 1985 by the Further Education Act 1985 (Commencement) (No. 1) Order 1985 (S.I. 1985/1429). The remaining provisions of the Act came into force on the days specified in section 7(2) and (3) of the Act: sections 5 to 8 on 16th July 1985 and sections 1 to 3 on 16th September 1985.
