The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 19(2), 54(2) and 56(3) of the National Health Service Reorganisation Act 1973(1) and of all other powers enabling him in that behalf, and after consulting such bodies recognised by him as representing persons who in his opinion are likely to be transferred or affected by transfers in pursuance of the orders mentioned in article 3 of the National Health Service (Transferred Staff-Appeals and Modification) Order 1982(2), hereby makes the following Order:-
1. This Order may be cited as the National Health Service (Transferred Staff- Appeals Amendment) Order 1987 and shall come into force on 4th September 1987.
2. In regulation 2 of the National Health Service (Transferred Staff-Appeals and Modification) Order 1982, for the first definition there shall be substituted the following:-
""Panel" means the appropriate panel for the hearing of appeals by employees in accordance with the agreement approved by the Secretary of State under the National Health Service (Remuneration and Conditions of Service) Regulations 1974(3) on 30th July 1987; and".

This Order amends the National Health Service (Transferred Staff-Appeals and Modification) Order 1982 which, in relation to questions arising from the 1974 reorganisation of the health service, had provided for such questions to be determined by the appropriate Panel specified in two agreements, one for England and the other for Wales, made by the General Whitley Council for the Health Service. The two agreements have been replaced by a single agreement and the definition of the word "Panel" has been amended to reflect this change.
The agreement is set out in section 34 of the General Whitley Council Conditions of Service Handbook copies of which may be obtained from the DHSS (Leaflets) Unit, PO Box 21, Stanmore, Middlesex, HA71AY.
