CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (No.2) Order 1987

Whereas the Secretary of State is of the opinion, as mentioned in section 1(1)(a) of the Food and Environment Protection Act 1985(1), that there has been or may have been an escape of substances of such descriptions and in such quantities and such circumstances as are likely to create a hazard to human health through human consumption of food;

And whereas he is of the opinion, as mentioned in section 1(1)(b) of the said Act, that in consequence of the said escape of substances, food which is, or may be in the future, in the areas described in the Schedule to the following Order, or which is, or may be in the future, derived from anything in those areas, is, or may be, or may become, unsuitable for human consumption;

Now, therefore, in exercise of the powers conferred on him by sections 1(1) and (2), and 24(1) and (3) of the said Act(2), and of all other powers enabling him in that behalf, he hereby makes the following Order:

Title, commencement and interpretation

1.-(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (No.2) Order 1987, and shall come into force on 13th August 1987.

(2) In this Order-

(a)"designated area" means one of the areas described in the Schedule to this Order;

(b)"sheep" means an animal of the genusOvis of whatever age or sex.

Designated incident

2. In the opinion of the Secretary of State food in the areas described in the Schedule to this Order, or which is derived from anything in those areas, is or may be unsuitable for human consumption in consequence of the following escape of substances:-

the escape on or after 26th April 1986 of radioactive substances from a nuclear reactorsituated at Chernobyl in the Ukraine, USSR.

Designated areas

3. The areas described in the Schedule to this Order are hereby designated for the purposes of Part I of the Food and Environment Protection Act 1985.

Activities prohibited in the designated areas

4. No person shall in any of the designated areas slaughter any sheep for human consumption or for use in the preparation of feeding stuffs.

Restrictions on movement

5. No person shall move any sheep from any farm, agricultural holding, agricultural premises, or holding in any of the designated areas.

Restrictions throughout the United Kingdom

6. No person shall in the United Kingdom-

(a)slaughter for human consumption or for use in the preparation of feeding stuffs any sheep that was in a designated area at any time after 12th August 1987; or

(b)supply, or have in possession for supply, any meat derived from a sheep or any food which contains any such meat, if that sheep was in a designated area at any time after 12th August 1987.

Article 3

SCHEDULETHE DESIGNATED AREAS

1. Dumfries and Galloway Region

a. The area of land within Stewartry District comprising that part of the Parishes of Glencairn and Dunscore bounded as follows:-

On the north from the point where the Walls Burn meets the boundary between Stewartry District and Nithsdale District running in an easterly direction through Craes Hill to Bogrie Hill and then in a southerly direction until the minor road north of Castramon Moor; then in a south-westerly direction to the Castramon Hill then in a westerly direction until the watercourse to the north of Craigenputtock Moor; then following the said watercourse in a westerly direction until it meets the Urr Water; then in a northerly direction following the Urr Water and the boundary between Stewartry District and Nithsdale District until the Walls Burn.

b. The area of land within Stewartry District comprising that part of the Parish of Kirkpatrick Durham bounded as follows:-

On the north from the point where the Craigenputtock Burn meets the Urr Water and running in a south-easterly direction to the Barr Hill plantation; then in a south-easterly direction following the western boundary of said plantation until it meets the Auchenhay Burn and then in a southerly direction by the said Burn to the point national grid reference NX773777; then in a westerly direction until Crogo Mill; and then following the Urr Water in a northerly direction until it meets the Craigenputtock Burn.

c. The area of land within Wigtown District comprising that part of the Parish of Minnigaff bounded as follows:-

On the north-west from the point where the Cross Burn meets the boundary between Dumfries and Galloway Region and Strathclyde Region running in an easterly direction following said boundary until it meets the boundary between Wigtown District and Stewartry Distict at the point national grid reference NX467873; then in a southerly direction following the western boundary of the forestry plantation and the boundary between Wigtown District and Stewartry District until it meets the River Dee to the south of Rig of Crow Nest; then following the eastern, northern and western boundaries of Ellergower Knowe plantation until it meets Loch Dee; then following round the western edge of Loch Dee to the point where it meets the White Laggan Burn; then in a westerly and then southerly direction following the boundary of White Laggan plantation until it again meets the White Laggan Burn; then in a south-easterly direction to Millfore Hill and continuing on to the Plantation south of Kirkloch; then following generally the western boundary of said plantation to the point where the Green Burn meets the Pulbae Burn; then in a northerly direction, following the boundary of the said plantation to the point national grid reference NX412711; then following the Coldstream Burn in a south-westerly direction until it meets the plantation south of Drannandow Farm; then in a northerly direction following the eastern boundary of Glentrool Forest passing to the south of Glenhead and Buchan steadings and following the boundary of Glentrool Forest to the south of Palgowan; then in a northerly direction following generally the eastern boundary of Glentrool Forest until the point where the Cross Burn meets the said Regional boundary.

d. The area of land within Nithsdale District comprising that part of the Parish of Kirkconnel bounded as follows:-

On the north from the point where the Polmarlach Burn meets the River Nith and running in an easterly direction by the River Nith to the point national grid reference NS693130; then in a southerly direction to, and crossing the Road A70 at the point national grid reference NS695125 and then continuing generally in a south-westerly direction through White Hill and south-westerly until the eastern boundary of the plantation at the point national grid reference NS682102 north of Polnagrie Hill; then following generally the eastern and northern boundaries of the said plantation until it meets the Polmarlach Burn; and then following the said Burn until it meets the River Nith.

2. Strathclyde Region

a. The area of land within Cumnock and Doon Valley District comprising that part of the Parishes of Dalmellington and Coylton bounded as follows:-

On the north from the point where the Burnhead Burn meets the boundary between the Parishes of Dalrymple and Dalmellington and running in a north-easterly direction by the said Burn and Parish boundary until the point where the boundaries of the Parishes of Dalrymple, Dalmellington and Coylton meet; and then in a northerly direction along the boundary between the Parishes of Dalrymple and Coylton to the point national grid reference NS458114; and then in a north-easterly direction until the western corner of the Kyle Forest Plantation; and then generally in a southerly direction following the western boundary of the said Plantation to the point national grid reference NS480094; and then generally in a south-westerly and south-south-westerly direction to the point where the path meets the unmetalled road at spot height 287; and then in a north-westerly direction along the said unmetalled road until it meets the Dunaskin Burn; and then in a westerly direction along the said Burn to the Castle at the point national grid reference NS450089; then in a north-easterly direction to where the path crosses the Burnhead Burn at the point national grid reference NS455092; and then following the said Burn in a northerly direction until the point where it meets the boundaries between the Parishes of Dalrymple and Dalmellington.

b. The area of land within Cumnock and Doon Valley District comprising that part of the Parish of Sorn bounded as follows:-

On the north from the point national grid reference NS540330 on the boundary between Cumnock and Doon Valley District and Kilmarnock and Loudoun District continuing in an easterly direction by the said boundary to the point national grid reference NS587325 on the said boundary; then in a south-westerly direction to the Road B7037 at the point national grid reference NS537302 and continuing in a north-westerly direction to where the said road crosses the Auchmannock Burn; then following the said Burn in a north-easterly direction to the point national grid reference NS542312 and continuing generally in a northerly direction to the boundary between Cumnock and Doon Valley District and Kilmarnock and Loudoun District at the point national grid reference NS540330.

c. The area of land within Cumnock and Doon Valley District comprising that part of the Parish of Dalmellington bounded as follows:-

On the north from the point national grid reference NS485029 continuing in an easterly direction by the southern boundary of the Bellsbank Plantation until it meets the Muck Water; then in a south-easterly direction by the Muck Water and the western boundary of another plantation to the point national grid reference NS511013; then in a southerly direction to the western edge of Loch Muck and continuing along the western and southern edges of said Loch to the boundary between Strathclyde Region and Dumfries and Galloway Region; and then continuing in a south-westerly direction by said boundary until it meets Loch Doon; and then continuing in a north-westerly direction by the north-eastern edge of said Loch until it meets the Eriff Plantation; then continuing along the eastern and northern boundaries of said Plantation until it again meets the eastern edge of Loch Doon; and then in a north-easterly direction to the point national grid reference NS485029.

d. The area of land within Cumnock and Doon Valley District comprising that part of the Parish of Auchinleck bounded as follows:-

On the north from the point national grid reference NS625249 in a north-easterly direction to the point national grid reference NS640257; then in a south-easterly direction to the course of the old railway at the point national grid reference NS644254 and continuing along the said course until it meets the boundary between the Parishes of Auchinleck and Muirkirk; then continuing generally in a south-easterly direction by the said Parish boundary until it meets the boundary between Cumnock and Doon Valley District and Clydesdale District; then continuing in a south-easterly direction by the said boundary until it meets the boundary of the Drummond Knowe Plantation; then following the western boundary of the said Plantation in a south-westerly direction until it meets the boundary between the Parishes of Auchinleck and New Cumnock; then continuing in a westerly direction by the said boundary and the boundary between the Parishes of Auchinleck and Old Cumnock to the point national grid reference NS636195 and continuing in a northerly direction to the point national grid reference NS636198, then continuing in a westerly direction to the small plantation and then continuing by the eastern and northern boundaries of the small plantation to the point national grid reference NS634202; and then in a north-westerly direction to the point national grid reference NS629215; then in a south-westerly direction to the western boundary of the small plantation at the point national grid reference NS627215 and following the northern and western boundaries of said plantation in a south-westerly direction then in a westerly direction to the point national grid reference NS618214; then following the eastern and northern boundaries of the said plantation and continuing generally in northerly direction from the north-western corner of the said plantation to the Road A70 at spot height 211; and then in a northerly direction to the point national grid reference NS625249.

e. The area of land within Cumnock and Doon Valley District comprising that part of the Parish of Muirkirk bounded as follows:-

On the north from the point national grid reference NS595310 and continuing generally in an easterly direction by the boundary between Cumnock and Doon Valley District and East Kilbride District until it meets the boundary between Cumnock and Doon Valley District and Clydesdale District and then continuing in a south-easterly direction by said lastmentioned boundary to the summit of Hare Craig; then in a southerly direction to the point national grid reference NS740304 and continuing generally in a westerly and southerly direction by the northern and western boundaries of the plantation until the western boundary meets the Ponesk Burn; then continuing in a south-westerly direction to the summit at spot height 368 and continuing in a north-westerly direction to Greenock Water at the point national grid reference NS701298; then in a south-westerly direction by Greenock Water to the point national grid reference NS670282 and continuing in a westerly and southerly direction by the northern and western boundaries of the Burnfoot Moor Plantation to the point national grid reference NS669274; then in a southerly direction to the point national grid reference NS668269 and continuing in a south-westerly direction by the south-eastern boundary of the Toll Plantation to the Road B743 at spot height 214; then continuing in a southerly direction to the River Ayr at the point national grid reference NS664262 and continuing generally in a north-easterly direction by said river to the point national grid reference NS720281; then in a south-easterly direction to the summit of Hawlk Hill and continuing in a south-easterly direction to the point national grid reference NS742262; then generally in a south-westerly direction by the boundary between Cumnock and Doon Valley District and Clydesdale District until it meets the boundary between the Parishes of Muirkirk and Auchinleck and continuing generally in a north-westerly direction by said boundary to the point national grid reference NS626270; then in a northerly direction to the point national grid reference NS629289 and continuing in a westerly direction to the point national grid reference NS611287; and then continuing generally in a north-westerly direction by the boundary between the Parishes of Muirkirk and Sorn to the point national grid reference NS595310.

f. The area of land within Cumnock and Doon Valley District comprising that part of the Parish of Old Cumnock bounded as follows:-

On the north from the point national grid reference NS628194 and continuing in a south-easterly direction by the boundary between the Parishes of Auchinleck and Old Cumnock until it meets the boundary between the Parishes of Old Cumnock and New Cumnock; then in a southerly then a north-westerly direction by said boundary to the point national grid reference NS628174 and continuing in a northerly direction to the point national grid reference NS629179; then generally in a northerly direction by the unnamed burn to the point national grid reference NS628194.

g. The area of land within Kyle and Carrick District comprising that part of the Parish of Straiton bounded as follows:-

On the north from the point national grid reference NS403059 continuing in an easterly direction along the southern boundary of the Lambdoughty Hill Plantation to the point national grid reference NS416062; then generally in a south-easterly direction by the Lambdoughty Burn and continuing in a south-easterly direction over the summit of Turgeny to the north-western corner of the Auldcraigoch Hill Plantation; then following the western boundary of said plantation to its western corner and continuing in a westerly direction to where the Chapel Burn runs into Baing Loch; then generally in a north-westerly direction to the point national grid reference NS410048 and continuing in a north-westerly direction by the watercourse to the point national grid reference NS403059.

h. The area of land within Kyle and Carrick District and comprising that part of the Parish of Straiton bounded as follows:-

On the north from the point national grid reference NS450025 continuing in a south-easterly direction over Rowantree Craig to the boundary between Kyle and Carrick District and Cumnock and Doon Valley District at the point national grid reference NS477015; then following the western edge of Loch Doon to the point where the Garpel Burn issues and continuing up said Burn in a westerly direction to the weir at the south-eastern end of Loch Finlas; then following generally the eastern edge of said Loch to its northern end and continuing in a north-westerly direction up the unnamed burn to the point national grid reference NX449998; then continuing in a north-westerly direction to the point national grid reference NS442015; then continuing in a north-easterly direction to Black Loch; and then continuing in a north-easterly direction to the point national grid reference NS450025.

i. The area of land on the Island of Arran within Cunninghame District comprising that part of the Parish of Kilbride bounded as follows:-

On the north from the point national grid reference NR969372 continuing in a north-easterly direction to the summit of Cul nan Creagan; then in a south-easterly direction to the western corner of the Torr Plantation and following the southern and eastern boundaries of said Plantation to the point national grid reference NR997372; then generally in a southerly direction to the point national grid reference NR999362 and continuing generally in a south-westerly direction to the boundary between the Parishes of Kilbride and Kilmory at the summit of Cnoc Dubh; then continuing in a north-westerly direction by the said boundary to the point national grid reference NR969372.

j. The area of land on the Island of Arran within Cunninghame District and comprising that part of the Parish of Kilmory bounded as follows:-

On the north from the point national grid reference NR955400 continuing in a south-easterly direction by the boundary between the Parishes of Kilmory and Kilbride until it meets the String Road; and then in a westerly direction by said road to the point national grid reference NR938348; then in a north-westerly direction to the summit of Garbh Thorr and continuing in a northerly direction over the summit of Beinn Tarsuinn to the point national grid reference NR939385; and then continuing in a north-easterly direction to the said Parish boundary at the point national grid reference NR955400.

k. The area of land within Kilmarnock and Loudoun District comprising that part of the Parish of Galston bounded as follows:-

On the north from the Glenoul Burn at the point national grid reference NS578360 continuing in a north-easterly direction to the point national grid reference NS588362; then generally in a southerly direction to the point national grid reference NS590355 and continuing along the watercourse in a south-easterly direction until it meets the Dubs Burn; then in a north-easterly direction by the said Burn to the point national grid reference NS597359 and continuing in a north-easterly direction and by a watercourse to the point national grid reference NS605369; then generally in a south-easterly direction to the boundary between Kilmarnock and Loudoun District and East Kilbride District at the point national grid reference NS618363 and following the said boundary in a south-westerly direction until it meets the boundary between Kilmarnock and Loudoun District and Cumnock and Doon Valley District; then following the said boundary in a northerly and westerly direction until it meets the Logan Burn; then continuing in a northerly direction by the said Burn until it meets the Glenoul Burn; and then continuing in a northerly direction by the Burn to the point national grid reference NS578360.

l. The area of land within Kilmarnock and Loudoun District comprising that part of the Parish of Fenwick bounded as follows:-

On the north from the point national grid reference NS475483 continuing in an easterly direction by the boundary between the Parishes of Fenwick and Stewarton and the Swinzie Burn to the point national grid reference NS492483; then in a northerly direction to the point national grid reference NS493487 and continuing in a south-easterly direction until the minor road at the point national grid reference NS502483; then in a south-westerly direction to the point national grid reference NS479466 and continuing in a north-westerly direction to the point national grid reference NS475471; then in a north-easterly direction to the point national grid reference NS478475 and continuing in a north-westerly direction to the point national grid reference NS475483.

m. The area of land within Kilmarnock and Loudoun District comprising that part of the Parish of Fenwick bounded as follows:-

On the north from the point national grid reference NS515471 and continuing in a north-easterly direction to the boundary between Kilmarnock and Loudoun District and Eastwood District; then in a north-easterly and south-easterly direction by said boundary until it meets the Rough Hill Plantation and continuing generally in a westerly direction by the northern boundary of said Plantation to the point national grid reference NS531459; then in a westerly direction to the boundary of the Flow Moss Plantation at the point national grid reference NS525459; then generally in a northerly direction by the eastern boundary of said Plantation to the point national grid reference NS515471.

n. The area of land within Kilmarnock and Loudoun District and comprising that part of the Parish of Galston bounded as follows:-

On the north from the point national grid reference NS615366 continuing in a north-easterly direction by the course of the old railway until it meets the boundary between East Kilbride District and Kilmarnock and Loudoun District; and then continuing in a south-easterly and westerly direction by said boundary to the point national grid reference NS619364 and continuing in a north-westerly direction to the point national grid reference NS618367; then in a south-westerly direction to the point national grid reference NS615366 and continuing in a north-westerly direction by the minor road until it meets the course of the old railway at the point national grid reference NS615366.

o. The area of land within East Kilbride District comprising that part of the Parish of Avondale bounded as follows:

On the north from the point national grid reference NS625371 continuing in a south-easterly direction to the point national grid reference NS631368; then in a north-easterly direction to the point national grid reference NS635369 and continuing in a south-easterly direction to the point national grid reference NS646364; then generally in a northerly direction by the road until it meets the Road B745 and continuing in a north-westerly direction by said road until it meets the boundary of the small plantation to the east of the road; then generally in an easterly direction and by the southern boundary of the said plantation to the point national grid reference NS654374 and continuing in a south-easterly direction to the Road A723 at the point national grid reference NS657373; then in a south-easterly direction by said road until it meets the boundary between East Kilbride District and Cumnock and Doon Valley District and continuing generally in a south-westerly direction by said boundary to the point national grid reference NS602310; then in a north-easterly direction to the summit of Hart Hill; then in a north-easterly direction to the summit of Little Hartmidden; then in a north-easterly direction to the summit of Anderside Hill; then in a northerly direction to the point national grid reference NS616346 and continuing in a north-westerly direction to the point national grid reference NS611347; then generally in a north-easterly direction by the boundary between East Kilbride District and Kilmarnock and Loudoun District to the point national grid reference NS625371.

p. The area of land within Eastwood District comprising that part of the Parish of Eaglesham bounded as follows:-

On the north from the point national grid reference NS503502 and continuing in a north-easterly direction to the point national grid reference NS510504; then continuing in a south-easterly direction to the point national grid reference NS517503 and then in a north-easterly direction to the point national grid reference NS524509; then continuing in a north-westerly direction to the point national grid reference NS523516 and continuing in a north-easterly direction to the point national grid reference NS533523; then continuing generally in a northerly direction to the point national grid reference NS533526 and then in a north-easterly direction to the point national grid reference NS547536; then in a south-easterly direction to the point national grid reference NS549534; then in a north-easterly direction by the unnamed burn until it meets the minor road between Mearns and Eaglesham, and then continuing in a south-easterly direction by said road to its junction with another minor road at the point national grid reference NS557537; then in a south-westerly direction by said road to the point national grid reference NS541520; then continuing in a south-easterly direction to the road B764 at the point national grid reference NS553508 and continuing in a south-westerly direction to the point national grid reference NS547501; and then continuing generally in an easterly direction by the Dunwan Burn to the point national grid reference NS569498; and then generally in a southerly direction to the point national grid reference NS572488 then in an easterly direction to the point national grid reference NS577488; then in a north-easterly direction to the point national grid reference NS587495 and continuing generally in a south-easterly direction to the point national grid reference NS592494; and then continuing in a south-easterly direction to the point national grid reference NS593491 then in a south-easterly direction to the point national grid reference NS595490; then continuing in a southerly direction to the point national grid reference NS596484 and in a south-easterly direction to the point national grid reference NS604482; then continuing generally in a south-westerly direction by the boundary between Eastwood District and East Kilbride District until it meets the boundary between Kilmarnock and Loudoun District and Eastwood District; and then continuing generally in a north-westerly direction by said District boundary to the point national grid reference NS503502.

a. The area of land within Stirling District comprising that part of the Parish of Killin bounded s follows:-

On the north from the point national grid reference NN494391 continuing in an easterly and southerly direction along the boundary between Central Region and Tayside Region to the point national grid reference NN585354; then continuing in a westerly direction and following the northern and western boundaries of the plantation and the burn Allt na Ceardaich to where it meets the River Lochay; then in a southerly direction to the point national grid reference NN568338 and continuing generally in a southerly direction along the western boundary of the Monemore Plantation to the southernmost corner of said Plantation; then in a south-easterly direction to the Road A827 and continuing in a south-westerly direction by said road to its junction with the Road A85; then in a southerly direction following said road until it meets the boundary between the Parishes of Killin and Balquhidder; then continuing in a westerly direction by said boundary to the point national grid reference NN470250; then continuing in a north-westerly direction to the south-eastern corner of the Meall Thairbh Plantation and continuing along the eastern and northern boundaries of said Plantation to the point national grid reference NN444272; then continuing in a northerly direction to the plantation to the north of the River Dochart and continuing in a northerly direction along the eastern boundary of said Plantation and in a westerly direction by the Allt Essan Burn to the point national grid reference NN419286; and then continuing in a northerly direction to the summit of Beinn nan Imirean; and then continuing in a north-easterly direction to the summit of Meall Glas; then continuing in an easterly direction to the summit at spot height 908; then continuing in a north-easterly direction to the summit of Beinn Cheathaich then continuing in an easterly direction to the summit of Meall a Churain; then in a north-easterly direction to the summit at spot height 881; then in an easterly direction to the summit at spot height 864; then in a south-easterly direction to the summit at spot height 766; then continuing generally in a northerly direction to and by the Allt Dubhchlair burn until it meets the River Lochay; then continuing in a north-easterly direction to the road and in a westerly direction by the road to where the Allt Lebhain burn meets the River Lochay; and then continuing generally in a northerly direction to the boundary between Tayside Region and Central Region at the point national grid reference NN494391.

b. The area of land within Stirling District comprising that part of the Parish of Balquhidder bounded as follows:-

On the north from the point national grid reference NN532244 continuing generally in a north-easterly direction until it meets the boundary between the Parishes of Balquhidder and Kenmore; then continuing in a southerly direction by said boundary until it meets the boundary between Central Region and Tayside Region; then continuing in a southerly direction to the point where the Kendrum Burn flows into Loch Earn and continuing in a south-westerly direction by said burn until it meets the dismantled railway; and then in a southerly direction by said dismantled railway until it meets the Road A84 and continuing in a south-westerly direction by said road to its junction with the road to Balquhidder at Kingshouse Hotel; then in a north-westerly direction by said road to Balquhidder until it crosses a small burn; then in a south-westerly direction by said burn until it meets the River Balvag and continuing in a north-westerly direction by said river until it meets a small burn then in a northerly direction by said burn to the Auchtubhmore Hill Plantation and continuing by the southern, western and northern boundaries of said plantation to the point national grid reference NN559217; and then continuing in a north-westerly direction to the summit of Meall an t -Seallaidh and then continuing in a north-westerly direction to the point national grid reference NN532244.

c. The area of land within Stirling District comprising that part of the Parish of Balquhidder bounded as follows:-

On the north from the point where the boundary between the Parishes of Callander and Balquhidder meets the boundary between Central Region and Tayside Region continuing in a south-easterly direction by said Regional boundary to the point national grid reference NN680134; then in a south-westerly direction along the Meall Leathan Dhail ridge to the spot height 452 and then in a south-westerly direction to the Tom Dubh Plantation; then in a south-westerly direction by the south-eastern boundary of said plantation to Keltie Water and continuing in a north-westerly direction by Keltie Water to the point national grid reference NN639094; then continuing in a south-westerly direction to the plantation and continuing generally in a south-westerly direction by the northern and western boundaries of the plantation and grounds of Leny House to the River Teith south of Kilmahog; then in a north-westerly direction by said river until it meets Loch Lubnaig and continuing in a northerly direction by the eastern edge of said Loch until it meets the boundary between the Parishes of Callander and Balquhidder; and then continuing in a north-easterly direction by said Parish boundary until it meets the boundary between Central Region and Tayside Region.

On the north from the point national grid reference NN486144 continuing generally in an easterly direction by the boundary between the Parishes of Callander and Balquhidder to the point national grid reference NN558122; then in a southerly direction to the summit of Ben Ledi; then in a south-easterly direction to the point national grid reference NN580077; then continuing in an easterly direction to the burn west of Samson's Stone and continuing in a south-easterly direction by the said burn to the plantation south of the Eas Gobhain River; then continuing generally in an easterly direction by the western and southern boundaries of the plantation to the Road A81 and continuing in a southerly direction by said road to the point national grid reference NN633062; then in an easterly direction to the River Teith and continuing in a southerly direction by said river until it meets the boundary between the Parishes of Callander and Kilmadock; then continuing in a south-westerly direction along said boundary until it meets the boundary between the Parishes of Callander and Port-of-Menteith; then continuing in a westerly direction by said boundary until it meets the boundary between the Parishes of Callander and Aberfoyle and continuing in a north-westerly direction along said boundary until it meets the Trossachs Plantation; then in a north-westerly direction by the eastern and northern boundaries of said plantation to the point national grid reference NN481108; then continuing generally in a northerly direction to the point national grid reference NN486144.

Explanatory Note

(This note is not part of the Order)

This Order contains emergency prohibitions restricting various activities in order to prevent human consumption of food rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reaction situated at Chernobyl in the Ukraine, USSR. This escape occurred in April 1986 and radioactivity had declined below the level which gave concern before the restrictions imposed in that year were finally removed. Contrary to original expectations, however, radioactivity at unacceptable levels is again present in new pasture.

Some areas in Scotland have already been designated by the Food Protection (Emergency Prohibitions) Order 1987 (S.I. 1987/1165).

This Order designates further areas in Scotland affected by the escape from which the movement of sheep and in which the slaughter of sheep are prohibited (articles 3, 4 and 5 and the Schedule). Restrictions on the slaughter of sheep from the designated areas, and the supply of meat derived from such sheep, extend throughout the United Kingdom (article 6).

Under section 21 of the Food and Environment Protection Act 1985 the penalty for contravening an emergency prohibition is-

(a)on summary conviction, a fine of an amount not exceeding the statutory maximum (at present £2,000);

(b)on conviction on indictment, an unlimited fine or imprisonment for a term of not more than two years, or both.

Powers of enforcement in relation to emergency prohibitions are conferred by section 4 of, and Schedule 2 to, the 1985 Act. Under paragraph 10 of that Schedule obstruction of enforcement officers is an offence.
