The Welsh Water Authority (Moreton-on-Lugg) (Acquisition of Mains) Order 1987

The Secretary of State for the Environment, on the application of the Welsh Water Authority, being statutory water undertakers(1), and in exercise of the powers conferred by sections 23, 312(1) and 59(1)(2) of the Water Act 1945(3) and now vested in him(4) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.-(1) This Order may be cited as the Welsh Water Authority (Moreton-on-Lugg) (Acquisition of Mains) Order 1987 and shall come into force on 8th September 1987.

(2) The Welsh Water Authority Orders 1976 to 1986 and this Order may be cited together as the Welsh Water Authority Orders 1976 to 1987.

Interpretation

2. In this Order-

"the Authority" means the Welsh Water Authority;

"the deposited plan" means the plan prepared in duplicate, signed by an Under Secretary in the Department of the Environment and marked "Plan referred to in the Welsh Water Authority (Moreton-on-Lugg) (Acquisition of Mains) Order 1987", one duplicate of which is deposited and available for inspection at the offices of the Authority at St Nicholas House, St Nicholas Street, Hereford and the other at the offices of the Secretary of State for the Environment;

"the specified mains" means the water mains, pipes and associated apparatus, the approximate positions of which are shown by red lines on the deposited plan used to supply water to properties in St Andrews Close in the parish of Moreton-on-Lugg in the County of Hereford and Worcester;

"the Third Schedule" means the Third Schedule to the Water Act 1945; and

"the undertaking" means the undertaking of the Authority as for the time being authorised by any enactment.

Power to acquire by agreement, continue and maintain works

3.-(1) The Authority may acquire by agreement and thereafter continue and maintain the specified mains.

(2) The specified mains, when acquired by the Authority shall for all purposes form part of the undertaking and for the purposes of the Third Schedule as applied to the undertaking the specified mains shall be deemed to have been laid or constructed by the Authority for the purpose of giving a general supply of water.

Application of section 94 of the Third Schedule

4. For the purposes of this Order section 94(5) of the Third Schedule (which requires copies of the Special Act to be kept by undertakers in their office and deposited with certain officers) shall apply to the undertaking and is hereby incorporated with this Order.
