HIGHWAYS, ENGLAND AND WALES

The London - Penzance Trunk Road A303 (Ilchester - South Petherton and Slip Roads) Order 1987

Made

7th September 1987

Coming into force

9th October 1987

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1. The new highways which the Secretary of State proposes to construct:-

(a)along the routes described in Schedule 1 to this Order (the highway along this route being in this Order referred to as "the main new trunk roads"); and

(b)along the routes described in Schedule 2 to this Order which connect the main new trunk road with other highways at the places stated in that schedule (the highways along these routes being in this Order referred to as "the slip roads"), shall become trunk roads as from the date when this Order comes into force.

2. The centre lines of the new trunk roads are indicated by heavy black lines on the deposited plan.

3. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that -

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purposes of through traffic.

4. In this Order -

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) "the deposited plan" means the plan numbered, HA 10/2 SWM 39, marked "The London - Penzance Trunk Road A303 (Ilchester - South Petherton and Slip Roads) Order 1987", signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(ii)"the new trunk roads" means the main new trunk roads and the slip roads.

5. This Order shall come into force on 9th October 1987 and may be cited as the London - Penzance Trunk Road A303 (Ilchester - South Petherton and Slip Roads) Order 1987.

SCHEDULE 1ROUTES OF THE MAIN NEW TRUNK ROADS

The routes of the main new trunk roads are routes between Ilchester and South Petherton in the County of Somerset as follows:

i)A route about 460 metres in length, starting at a point 8 metres southwest of the centre line of the existing B3165 Prophets Lane junction with the Trunk Road in a north easterly direction and ending at a point 10 metres north east of the centre line of the existing Trunk Road/B3165 junction at Ringwell Hill, the new route being given the reference number 1 on the deposited plan;

ii)a route about 652 metres in length, starting at a point 410 metres northeast of the centre line of the existing Trunk Road/B3165 junction at Ringwell Hill in a north easterly direction and ending at a point 229 metres north east of the eastern boundary of OS Plot No. 6372 containing the property known as Percombe House, the new route being given the reference number 2 on the deposited plan; and

iii)a route about 671 metres in length, starting at a point 207 metres north east of the centre line of the existing Trunk Road/Yeovil Road C139(N) junction at Tintinhull Forts in a north easterly direction and ending at a point 34 metres north east of the centreline of the existing access to Tailes Farm, the new route being given the reference number 3 on the deposited plan.

SCHEDULE 2ROUTES OF THE SLIP ROADS

The routes of the slip roads are the following:

Junctions with the Trunk Road at Prophets Lane and Ringwell Hill.

Three routes to connect the eastbound and westbound carriageways to the improved London-Penzance Trunk Road and the main new trunk road with the principal road B3165 known as Prophets Lane and the principal road B3165 known as Ringwell Hill (the new trunk roads along these routes being respectively given the reference letters A, B and C on the deposited plan).
