IMMIGRATION
Made
2nd December 1987
Laid before Parliament
10th December 1987
Coming into force
1st January 1988
In exercise of the powers conferred upon me by sections 9(2) and 32(1) of the Immigration Act 1971(1), I hereby make the following order:
1. This Order may be cited as the Immigration (Control of Entry through Republic of Ireland) (Amendment) Order 1987 and shall come into operation on 1st January 1988.
2. In article 4(4)(c) of the Immigration (Control of Entry through Republic of Ireland) Order 1972(2) the word "Greece" shall be omitted.
Douglas Hurd
One of Her Majesty's Principal Secretaries of State
Home Office
2nd December 1987
(This note is not part of the Order)
Article 4 of the Immigration (Control of Entry through Republic of Ireland) Order 1972 provides, inter alia, that certain persons who do not have the right of abode and who enter the United Kingdom from the Republic of Ireland after coming from a place outside the common travel area or after leaving the United Kingdom while having a limited leave to enter or remain there which has since expired, are prohibited from taking up employment except where they are nationals of States who are members of the European Community other than Greece, Portugal and Spain.
The exception made in respect of Greek nationals was necessary because, although Greece became a member of the Community on 1st January 1981, Articles 44 to 47 of the Greek Accession Treaty of 28th May 1979 (Cmnd. 7650) provided that workers who were Greek nationals could not enjoy rights of free movement within the Community until the end of the transitional period on 1st January 1988. This Order consequently deletes the reference to a national of Greece in Article 4 of the 1972 Order to reflect the fact that such a national enjoys full rights of free movement as from 1st January 1988.
Similar transitional provisions in respect of Spanish and Portuguese nationals are contained in the Spanish and Portuguese Treaty of Accession of 12th June 1985 (Cmnd. 9634) but the transitional period for Spain and Portugal does not end until 1st January 1993.
