VIDEO RECORDINGS

The Video Recordings Act 1984 (Commencement No. 6) Order 1987

In exercise of the powers conferred upon me by section 23(2) of the Video Recordings Act 1984(1), I hereby make the following Order:

1.-(1) This Order may be cited as the Video Recordings Act 1984 (Commencement No. 6) Order 1987.

(2) This Order does not extend to Scotland.

(3) In this Order-�

"the Act" means the Video Recordings Act 1984;

"the 1985 Order" means the Video Recordings Act 1984 (Commencement No. 2) Order 1985(2).

2.-(1) Subject to paragraph (2) below, sections 9 and 10 of the Act shall come into force on 1st March 1988 for the purpose of prohibiting the supply, the offer to supply or the possession for the purpose of supply of a video recording to which article 3(a) of the 1985 Order does not apply and which contains a video work which satisfies the requirements in paragraph (3) below.

(2) Where a video recording to which paragraph (1) above applies contains another video work not being a work which satisfies the requirements in paragraph (3) below, sections 9 and 10 of the Act shall come into force for the purpose set out in paragraph (1) above only in respect of the video work which satisfies those requirements.

(3) The requirements which a video work must satisfy are that-�

(a)its visual images, when shown as a moving picture, are substantially the same as the moving picture produced on showing a film registered under Part II of the Films Act 1960(3) on or after 1st January 1970;

(b)its visual images are accompanied by sound which comprises or includes words predominantly in the English language; and

(c)no classification certificate has been issued in respect of it.

Explanatory Note

(This note is not part of the Order)

This Order brings sections 9 and 10 of the Video Recordings Act 1984 into force in England, Wales and Northern Ireland for certain purposes on 1st March 1988. The sections are brought into force in Scotland on the same day and for the same purposes by the Video Recordings Act 1984 (Scotland) (Commencement No. 6) Order 1987.

Sections 9 and 10 create the offences of supplying, offering to supply and possession for the purpose of supply of a video recording containing an unclassified video work. This Order brings these sections into force in respect of an unclassified English language video work which has been sold, let on hire or offered for sale in the United Kingdom to the public in video form before 1st September 1985 (and to which article 3(a) of the Video Recordings Act 1984 (Commencement No. 2) Order 1985 does not therefore apply) and of which a film version was registered on or after 1st January 1970 under Part II of the Films Act 1960.

1960 c. 57. The Films Act 1960 was repealed by section 7(1) of, and Schedule 2 to, the Films Act 1985 (c. 21) but the register under Part II continues to be kept under section 7(3) of the 1985 Act for the purpose set out therein.
