The Secretary of State for Social Services, in exercise of powers conferred on him by section 29 of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:-

Citation and commencement

1.  These Regulations may be cited as the National Health Service (General Medical and Pharmaceutical Services) Amendment (No. 3) Regulations 1987 and shall come into force on 6th April 1987.

Amendment of Regulations

2.-(1) The National Health Service (General Medical and Pharmaceutical Services) Regulations 1974(2) shall be amended in accordance with the following paragraphs of this regulation.

(2) In Part I of Schedule 1 (terms of service for doctors), in paragraph 31(2) there shall be added after head (b)(3) the following:-

"(c)Part V of, and Schedule 4 to, the Social Security Act 1986(4) shall be issued in accordance with any regulations made under those provisions of that Act(5).".

(3) In Schedule 3 (list of prescribed certificates) in column 2 opposite the first three items in column 1 there shall be inserted at the end"Part V of, and Schedule 4 to, the Social Security Act 1986 (1986 c. 50)".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (General Medical and Pharmaceutical Services) Regulations 1974 ("the 1974 Regulations") which regulate the terms on which doctors and chemists provide general medical services and pharmaceutical services under the National Health Service Act 1977.

Part I of Schedule 1 to the 1974 Regulations contains the terms of service for doctors providing general medical services. These Regulations amend paragraph 31 of that Schedule by adding a requirement that where a certificate is given by a doctor under that paragraph for the purposes of statutory maternity pay it must be issued in accordance with regulations made under the Social Security Act 1986.

Schedule 3 to the 1974 Regulations lists the certificates which, under his terms of service, a doctor must issue free of charge and includes a list of enactments under or for the purposes of which the certificates are required. These Regulations add Part V of, and Schedule 4 to, the Social Security Act 1986 to that list.
