The Police and Criminal Evidence Act 1984 (Application to Customs and Excise) Order 1987

The Treasury, in exercise of the powers conferred on them by section 114(2) of the Police and Criminal Evidence Act 1984(1), hereby make the following Order:

1.  This Order may be cited as the Police and Criminal Evidence Act 1984 (Application to Customs and Excise) Order 1987 and shall come into force on 7th April 1987.

2.  In this Order, unless the context otherwise requires-

"the Act" means the Police and Criminal Evidence Act 1984;

"the principal Order" means the Police and Criminal Evidence Act 1984 (Application to Customs and Excise) Order 1985(2).

3.  The following section of the Act shall be added to Schedule 1 to the principal Order (provisions of the Act applied to Customs and Excise)-

4.  The following equivalent grades shall be added to part 2 of Schedule 2 to the principal Order-

Explanatory Note

(This note is not part of the Order)

Article 3 of the Order extends the provisions of the Police and Criminal Evidence Act 1984 which apply to officers of Customs and Excise by applying section 107 of the Act.Section 107 will enable an officer of a lower grade, subject to authorisation, to exercise powers in respect of the investigation of offences or the treatment of persons in custody otherwise exercisable only by an officer of a higher grade or with that officer's authority.

Article 4 substitutes for police ranks included in section 107 of the Act the equivalent Customs and Excise grades.
