1. The Essex County Council (Maldon Bypass) (Chelmer Viaduct) Scheme 1986 is hereby confirmed without modifications.
2. The said Scheme as confirmed (hereinafter referred to as "the Scheme") is set out in the Schedule hereto. Copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, and at the offices of the Chief Executive and Clerk, Essex County Council, at the County Hall, Chelmsford.
3. The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
4. This Instrument may be cited as the Essex County Council (Maldon Bypass) (Chelmer Viaduct) Scheme 1986 Confirmation Instrument 1987.

The Essex County Council (hereinafter referred to as "the Council") make this Scheme in exercise of their powers under section 106 of the Highways Act 1980 and of all other enabling powers:-
1. The Council are authorised to construct over the navigable waters of the River Chelmer in the Borough of Maldon in the County of Essex the bridge specified in the Schedule to this Scheme as part of the new highway being a bypass of Maldon, which they are proposing to construct along the line of the disused railway track between the site of the Old Maldon West railway station at Spital Road, Maldon and the former level crossing at Fullbridge (A414) Maldon.
2. This Scheme may be cited as the Essex County Council (Maldon Bypass) (Chelmer Viaduct) Scheme 1986.
The Chelmer Viaduct is to be located at the site of the remains of the old railway viaduct over the River Chelmer 600 metres upstream and west of Fullbridge (A414).
The substructure is to be constructed in concrete and clad in brickwork while the deck is to be constructed in steel and concrete surmounted with an aluminium parapet as shown on drawing Nos B939/S11 and B939/S12.
The bridge is to be 13.3 metres wide overall carrying a single 7.3 metres wide carriageway and two hardened verges. There are to be three spans, one of 42.5 metres across the River Chelmer and two additional side spans each of 25.5 metres. The headway above Mean High Water Ordinary Spring Tide level is to be 4.5 metres at the centre and 3.5 metres at the edge of the opening. This is considerably more than the 1.1 metres available at Fullbridge downstream. The width of the navigable opening will be 39 metres which is substantially larger than the 23 metres width presently available at this location.
