The Local Government Reorganisation (Property) (Tyne and Wear) Order 1988

Whereas the Tyne and Wear Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted proposals to the Secretary of State for the transfer of certain of its properties to local authorities, and he has decided to give effect to those proposals without modification;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Local Government Reorganisation (Property) (Tyne and Wear) Order 1988 and shall come into force on 22nd July 1988.

(2) In this Order "the Body" means the Tyne and Wear Residuary Body.

Specified Land

2. There shall vest in each local authority mentioned below the land of the Body which is specified in the corresponding Schedule-

Bowes Railway

3. Any land forming the course or former course of the Bowes Railway, and any land associated with and adjoining such land, which is vested in the Body shall vest in the local authority in whose area the land is situated.

Rights and liabilities

4. All rights and liabilities acquired or incurred by the Body exclusively in connection with any land transferred by this Order shall vest in the local authority to which that land is transferred.

SCHEDULE 1LAND TRANSFERRED TO GATESHEAD METROPOLITAN BOROUGH COUNCIL

Sites of Nos. 5, 7 and 9 Oldwell Lane, Winlaton.

The parcels of land consisting of the approximate area mentioned below and situated as so mentioned-

Sites of Nos. 29 and 31 Stamfordham Road, Newcastle.

A parcel of land consisting of approximately 200 square metres and including the substation site, situated at the north end of Sandyford House car park, Jesmond.

SCHEDULE 3LAND TRANSFERRED TO NORTH TYNESIDE METROPOLITAN BOROUGH COUNCIL

The Council Depot, Cleadon Lane, East Boldon.

Site of former garage, Whitburn Bents Road, Whitburn.

Site of former Wright's and United Biscuit Factory, Boldon Lane, South Shields.

Wessington North Industrial Estate, Castellian Road, Castletown.

Site of former garden house, Wades Row, High Moorsley.

365 square metresAlong the south side of Dame Dorothy Street, Bonnersfield approximately 30 metres east of Rendlesham Street.
19.87 hectaresAt High Moorsley extending in a northerly direction from a point approximately 90 metres north of Front Street to the stream located approximately 330 metres north of the course of the dismantled railway.

Explanatory Note

(This note is not part of the Order)

This Order transfers certain land owned by the Tyne and Wear Residuary Body to the district councils in whose area the land is situated. The transfers are in addition to those effected by the Local Government Reorganisation (Property) (Tyne and Wear) Order 1987 (S.I. 1987/1288).

Article 2 transfers the land specified in Schedules 1 to 5.

Article 3 transfers land relating to the Bowes Railway.

Article 4 provides for the transfer of rights and liabilities ancillary to the land transferred.
