CHILDREN AND YOUNG PERSONS

The Children and Young Persons (Amendment) Act 1986 (Commencement No. 1) Order 1988

The Lord Chancellor, in exercise of the powers conferred on him by section 5(2) of the Children and Young Persons (Amendment) Act 1986(1), hereby makes the following Order:

1. This Order may be cited as the Children and Young Persons (Amendment) Act 1986 (Commencement No. 1) Order 1988.

2. Sections 2 and 3 of the Children and Young Persons (Amendment) Act 1986 shall come into force on 1st August 1988.

Explanatory Note

(This note is not part of the Order)

This Order brings sections 2 and 3 of the Children and Young Persons (Amendment) Act 1986 into force on 1st August 1988. Section 2 provides for a parent or guardian to have an automatic right of appeal from care proceedings. Section 3 enables a parent or guardian to be made a party to care proceedings when there is a conflict of interest between the parent and child. Further, section 3 provides that grandparents may, by leave of the court and in accordance with criteria given in Rules, become parties to care proceedings.
